Terms and conditions of sale

This English version is provided for convenience; the French version prevails.

These terms govern orders placed on shineness.beauty by consumers receiving goods in metropolitan France. They are presented before payment and accepted when ordering.

Products

The site offers SHINE’NESS Brow Gel (clear eyebrow gel, 8 g), SHINE’NESS Brow Brush (dual eyebrow brush: comb and spoolie) and the SHINE’NESS Brow Gel + Brush set. On invoices they may appear under their French names (“Brosse sourcils”, “Brow Gel + Brosse”). Ingredients printed on the gel box: Water, Ceteareth-30, Glycerin, PVP, 1,2-Hexanediol, Hydroxyacetophenone.

Directions as printed on the packaging: “Pick up a small amount of gel with our brush. Apply in short upward strokes to shape and define brows, allow to dry for a long-lasting hold.”

Prices

Prices shown on the site are in euros including French VAT at 20%. The price displayed when the order is placed applies. Delivery costs are added according to the method chosen (see Shipping).

Orders and payment

The customer selects a product and is redirected to Shopify’s secure checkout page. There, the customer enters an email address, a delivery method and address (home delivery by Colissimo or a Mondial Relay pickup point) and a payment method (card or another method offered on the checkout page). These terms are available from the checkout page; by placing the order, the customer confirms having read and accepted them.

Payment is taken immediately. The contract is concluded when payment is confirmed. The customer then receives an order confirmation email stating the order number, followed by a shipping email with a tracking number. An invoice is issued for every order. SHINE’NESS may refuse an abnormal or fraudulent order.

Shipping

Shipping is limited to metropolitan France. Delivery to a Mondial Relay pickup point is free; Colissimo home delivery is charged €5 incl. VAT. The applicable delivery cost is shown before the order is placed. Orders are dispatched within 1–2 business days after the order. Estimated delivery is 2 to 5 business days after dispatch. Delivery is by Colissimo (home delivery) or Mondial Relay (pickup point), as chosen by the customer at checkout.

Risk of loss or damage passes to the consumer upon physical receipt (article L. 216-4 of the French Consumer Code). If delivery is late, the consumer may give formal notice to deliver within a reasonable additional period, then cancel if delivery still does not occur, under article L. 216-6.

Withdrawal and returns

The consumer has 14 days from receipt of the goods to withdraw without giving a reason (article L. 221-18). The consumer may notify SHINE’NESS through the online withdrawal function, by email to contact@shineness.beauty, or using the model form below. Notice must be sent before the period expires.

After notifying us, the consumer returns the goods within 14 days to SHINE’NESS – Returns, 47 rue Vivienne, 75002 Paris, France. The consumer bears the direct return costs. SHINE’NESS refunds all sums paid, including initial delivery costs, within 14 days of being informed, by the same payment method. Under article L. 221-24, reimbursement may be deferred until the goods or proof of their dispatch is received.

The exception in article L. 221-28(5) concerns goods unsealed after delivery that cannot be returned for health protection or hygiene reasons. The Brow Gel is delivered in a box sealed with plastic film: once that film has been removed after delivery, the gel can no longer be returned for hygiene and health-protection reasons (article L. 221-28, 5°). As long as the film is intact, it can be returned. The brush remains subject to the ordinary withdrawal right.

Statutory guarantees

SHINE’NESS is responsible for the statutory guarantee of conformity under articles L. 217-3 to L. 217-20 of the French Consumer Code and the guarantee against hidden defects under article 1641 and following of the French Civil Code. Information on statutory guarantees

The consumer has two years from delivery to invoke the statutory guarantee of conformity when a lack of conformity appears. During that period, the consumer need only establish that the defect exists, not when it arose.

The consumer is entitled to repair or replacement within 30 days of the request, free of charge and without major inconvenience. Repair extends the original guarantee by six months. If the consumer requests repair but the seller imposes replacement, a new two-year period begins upon replacement.

The consumer may keep the goods and receive a price reduction, or end the sale and return them for a full refund, if the seller refuses repair or replacement, takes more than 30 days, causes major inconvenience, or fails to remedy the defect. A sufficiently serious defect may justify an immediate price reduction or cancellation. A minor defect does not justify cancellation. Time during which goods are unavailable for repair or replacement suspends the remaining guarantee period.

These rights follow articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who obstructs them in bad faith may face the civil fine under article L. 241-5.

The consumer also has the statutory guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. The consumer may keep the goods with a price reduction or return them for a full refund.

After a written complaint remains unresolved, the consumer may use a consumer mediator free of charge under article L. 612-1 of the French Consumer Code: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice) — 49 rue de Ponthieu, 75008 Paris, France — www.cm2c.net (online complaint form).

Applicable law

French law applies to these terms. The consumer may bring proceedings before the competent court at their place of domicile.
